1. Terms of sale

Who you are buying from

These terms apply when you buy a course or a membership from nailknowledge.org.

The courses are made and provided by Nail Knowledge Limited, a company registered in England and Wales (company number 16778444), registered office Prospect House, 1 Millennium Way, Pride Park, Derby, England, DE24 8HG. VAT number 507 9234 84. You can reach us at [email protected].

Payment is handled by Paddle.com Market Limited, who act as the authorised reseller for everything sold on this site. That means Paddle is the seller on your receipt and your invoice comes from them. We provide the courses, your account, and all support to do with the learning itself.

What you are buying

We sell two things on this website.

A course, bought outright. One payment. You own that course for good, there is no renewal and nothing further to pay. If your membership ends, or you never had one, a course you bought outright stays yours.

Nail Era Pro membership — £49.99 a year. This opens every course we sell, including new ones we add while your membership is running. It renews automatically each year until you cancel. Membership is access for as long as you are a member, not ownership: when your membership ends, the courses it opened close again. See Section 3.

You can do both. If you are a member and you want to keep a particular course permanently, you can buy it outright, and that purchase survives your membership ending.

The MyNailEra app itself is free. You do not need a membership or a purchase to use it, and the free part of the app stays free.

When your access starts

Straight away. As soon as your payment goes through, the course or the membership opens in the app and on the website, under the account you bought it with. Sign in with the same email address you used to pay.

Because access starts immediately, there is something you need to know about your right to cancel, that is section 2, and it is the most important part of this document.

What “lifetime” means

Where we say a course is yours for life, we mean exactly that: one payment, no renewal, no expiry date, and we will not take it away from you or move it behind a membership later.

Being straight about the one limit: it means for as long as we are running the service. We are not promising the internet, or this company, will exist forever, and no one selling online courses can promise that. What we are promising is that we will not end your access for any reason of our own, and that if we ever had to close the service we would tell you in advance.

What we owe you about quality

Separately from anything in these terms, the law says digital content must be of satisfactory quality, fit for purpose, and as described (Consumer Rights Act 2015, ss.34, 35 and 36). Section 36 also makes the description of the course you saw before buying part of the contract, and says a change to it *”is not effective unless expressly agreed between the consumer and the trader”*.

If a course does not meet that standard, you have a legal right to have it fixed, or to a reduction in the price, and in some cases a full refund (ss.42, 43, 44 and 45). Those rights are yours whatever these terms say, and nothing here reduces them.

Our right to cancel, and refunds

The law, and why the checkout has to ask you something

Buying online, you normally get 14 days to change your mind, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Regulation 29(1) gives the right, and regulation 30(1) says that for digital content the 14 days run from the day the contract is made.

But that right can be lost, and for instant-access digital content it usually is. Regulation 37 is the provision, and it is precise about what has to happen first:

Both limbs. Consent alone is not enough, the customer must also acknowledge what it costs them. Regulation 37(2) then removes the cancellation right once supply has begun and both conditions are met. And regulation 37(4) is the sting: if we begin supply without getting both, the customer bears no cost for what they were supplied.

Two further consequences worth building for rather than discovering later:

Regulation 16(3) requires us to confirm the consent and the acknowledgement to the customer on a durable medium, in practice, in the order confirmation email. Not just collect it; confirm it back.

Regulation 31 extends the cancellation period by up to 12 months if we fail to give the required information about the right to cancel. Getting this wrong does not produce a small problem; it produces a year of open-ended cancellation rights.

The refund policy

Before your access opens. If you have not ticked the immediate-access box, you have 14 days from buying to change your mind, for any reason, and get all your money back. Just tell us, an email saying you want to cancel is enough (regulation 32 says any clear statement will do). We will refund you within 14 days of hearing from you, to the card you paid with, with no fee (regulation 34).

After your access opens. Once you have ticked the box and your access is open, the 14-day right to change your mind no longer applies. That is regulation 37, and it is the trade for getting your course immediately.

If something is wrong with the course. This is different, and it is not affected by any of the above. If a course is faulty, doesn’t work, or isn’t what we described, you have rights under the Consumer Rights Act 2015 and we will put it right, by fixing it, by refunding part of the price, or by refunding all of it, depending on what has gone wrong (ss.42–45). Email us and tell us what happened. If a refund is due, we will refund you within 14 days using the same payment method you used to pay, with no fee, in accordance with the Consumer Rights Act 2015.

If you bought by mistake.

How to ask. Email [email protected]. Because Paddle is the seller of record, they may process the refund itself, but you do not need to work out who to contact. Ask us and we will handle it.

3. Membership, and how renewal works

What it costs and when. Nail Era Pro is £49.99 a year. You pay when you join, and then on the same date each year.

It renews automatically. Unless you cancel, we will take £49.99 from your card on your renewal date each year, and your membership continues for another year. We will email you before that happens, so it is never a surprise on your statement.

Cancelling. You can cancel at any time, from your account page, in a couple of clicks. You do not need to phone anyone, email anyone, or give a reason. Cancelling stops the next payment.

What happens when you cancel. Your membership runs to the end of the year you have already paid for, cancelling does not cut it short, and we do not refund part-years. When it does end:

Courses you bought outright stay yours. They are unaffected. Cancelling a membership never touches a course you paid for separately.

Courses you only reached through membership will close. They come back if you re-join.

Your progress is kept. If you re-join, or buy one of those courses outright later, you pick up where you left off.

A diploma certificate you have already earned is yours permanently. Passing the exam is not something we can un-pass. You keep the qualification; you lose access to the course content behind it, the same way any qualification works.

To keep a course permanently, buy it outright. That is the only way. If there is a course you would want to keep after your membership ends, you can buy it outright at any time, during your membership or after it ends, and it is then yours for good. If you are coming to the end of a membership and want to keep some of what you have been using, it is the courses you would need to buy, one by one.

If the price changes. We will not change the price of a renewal without telling you first. If we ever do, we will email you at least [30 days] before the renewal date, and you can cancel before the new price takes effect if you do not wish to renew.

4. Fair use

Right now, there are no limits. Ask Era, photo critiques and personalised tutorials are not capped, not for members, not for people who have bought a course, and not for people using the app for free. Use them as much as you like.

We may add a fair-use allowance in future. These features cost us money each time they are used, and a very small number of people could use them heavily enough to make that a problem. If that ever happens, we may introduce a reasonable daily allowance so the service stays affordable and stays fast for everyone.

If we do, here is what we promise. We will email you before it starts, not after. Any allowance will be set well above what an ordinary person uses, it is there to catch extremes, not to ration normal use. Anyone who has paid us anything will get more than anyone who hasn’t. And if you are a member and you do not like the change, you can cancel before it takes effect.

What this clause is not. It is not permission for us to quietly cut down what you get. We are not reserving the right to reduce your course access, remove content you bought, or shorten a membership. This is about the usage-based features only.

5. What these terms do not cover

Anything you buy inside the app. If you buy a course or a membership through the MyNailEra app on an iPhone, iPad or Android device, that purchase is made through Apple or Google, not through us. Their terms govern it, they take the payment, and refunds for those purchases have to be requested from Apple or Google, we cannot issue them, however much we might want to. Apple’s are at reportaproblem.apple.com; Google’s are in the Play Store under your order history. The courses are the same either way; only the till is different.

The diploma qualification itself. The accredited diploma is £39.99, paid once, and the content is yours for life. But the assessment, the exam, the pass mark and the certificate are governed by the diploma’s own rules, not by these terms. Passing is a matter of your exam result, and once you have passed, the certificate is permanently yours, including if you later let a membership lapse.

College and training-provider seats. If you are studying through a college, salon academy or training provider who bought your place, you did not buy anything from us and these terms are not your contract. Your access comes through them, and questions about it go to them.

Third-party services. Video hosting, payment processing and email delivery are provided by other companies under their own terms. We have chosen them carefully but we do not control them.
